Acceptable Use Policy

1. Introduction and Purpose
This Acceptable Use Policy governs the permitted use of https://swansta.com, https://starwn.com and the related Platform functionality operated by SWANSTAR ENTERPRISES LIMITED.
It applies to Website visitors, registered Users, Customers, Business Representatives, applicants and Independent Service Performers to the extent that they access or use the Platform, submit or assess Project Requests, place or perform Orders, upload User Materials, communicate through the Platform or otherwise participate in Platform activity.
The Company owns and operates the Websites and provides the Platform Services, including Account administration, service discovery, communication, Order administration, payment facilitation, electronic delivery, support, security, fraud prevention and enforcement of Platform rules.
The Company does not itself create, write, design or deliver the Marketing Services displayed through the Websites. Marketing Services are independently offered and performed by Independent Service Performers acting on their own behalf. Unless the applicable Order Confirmation expressly states otherwise, the contract for the performance of Marketing Services is between the Customer and the identified Service Performer.
The purpose of this Policy is to ensure that the Platform, Project Requests, Marketing Services, User Materials, communications and Deliverables are used lawfully, honestly, professionally and consistently with the intended operation of Swansta and Starwn.
This Policy is intended to reduce the risk that the Platform or Marketing Services are used to create, support or distribute unlawful, fraudulent, misleading, infringing, abusive or materially harmful content or activity. It also protects the security and integrity of the Platform and the legitimate interests of Users, Service Performers, payment providers, business partners and third parties.
The Company may assess Platform activity and take proportionate action where it reasonably believes that an intended or actual use breaches this Policy, the Terms & Conditions, an Order Confirmation or applicable law. Such action may include requesting clarification, rejecting a Project Request, restricting User Materials, pausing an Order, limiting Account functionality or suspending or terminating access in accordance with the Terms & Conditions.
This Policy must be read together with the Terms & Conditions, Privacy Policy, applicable Service Listing, Order Confirmation and any Service Performer or project-specific terms accepted through the Platform.
2. Definitions
For the purposes of this Acceptable Use Policy, the following terms apply.
Account means a personal account registered through either Website in the name of a specific individual.
Applicable Law means any law, regulation, court order, binding regulatory requirement or legally enforceable obligation applicable to the Company, the relevant User, the relevant Service Performer, the Project Request, the Order, the Marketing Services or the intended use of the Deliverables.
Business Representative means an individual authorised to use the Platform on behalf of a business, organisation or other legal entity. The Account remains registered in the name of that individual.
Company, we, us or our means SWANSTAR ENTERPRISES LIMITED, company number 16864192, with its registered office at International House, 50 Essex Street, London, England, WC2R 3JF.
Customer means a User who submits a Project Request, confirms an Order or purchases Marketing Services through the Platform.
Deliverables means the digital visual materials, written content, documents, plans or other results identified in an Order Confirmation.
Independent Service Performer or Service Performer means an independent third-party professional who offers and performs Marketing Services through the Platform on their own behalf and is not an employee, worker, agent, partner or representative of the Company.
Marketing Services means the static visual marketing, written content, copywriting, planning, communication and related professional services offered through the Platform by Independent Service Performers.
Order means a confirmed project engagement created after the Customer accepts the identified Service Performer, scope, Deliverables, price and other material terms.
Platform or Platform Services means the digital marketplace, Account, service discovery, communication, Order administration, payment facilitation, delivery and support functionality operated by the Company through the Websites. Platform Services do not include the independent creation or delivery of Marketing Services.
Prohibited Activity means any content, conduct, business activity or use of the Platform, Marketing Services or Deliverables that is prohibited under this Policy.
Project Request means an initial enquiry or description of potential Marketing Services. A Project Request is not an Order and does not confirm acceptance, price, scope, delivery or Service Performer availability.
Reference Materials means permitted images, documents, video files or other materials supplied solely to explain a project or provide visual or informational context.
User Materials means briefs, instructions, files, content, communications and other information submitted through the Platform by a User.
User or you means an individual who accesses or uses the Platform on their own behalf or as an authorised Business Representative.
Websites means https://swansta.com, https://starwn.com and their related pages, interfaces and Account areas.
Capitalised terms not defined in this Policy have the meanings given to them in the Terms & Conditions.
3. Acceptable Use
Users may access and use the Platform only for lawful, legitimate, authorised and good-faith purposes consistent with the Platform model and the categories of Marketing Services offered through the relevant Website.
Swansta supports static visual marketing services, while Starwn supports written content, content planning and marketing communication services. The available services and exact Deliverables are determined by the applicable Service Listing and Order Confirmation.
Users may submit Project Requests, communicate requirements, upload relevant User Materials, review Service Listings, confirm Orders, process payments through authorised providers, participate in revisions, receive Deliverables and submit support or complaint requests through the functionality made available by the Platform.
Project Requests and User Materials must contain information reasonably necessary to understand the requested Marketing Services. Instructions must be accurate, lawful and sufficiently clear to allow the relevant Service Performer to assess or perform the project.
Video files may be uploaded solely as Reference Materials where they are reasonably necessary to explain the project or provide visual or informational context. Uploading a video does not make video production or video editing part of the Marketing Services or Deliverables.
Customers may use completed Deliverables for lawful personal, commercial, promotional, editorial, educational or internal business purposes, subject to the applicable Order Confirmation, intellectual property rights, third-party licences and Applicable Law.
Deliverables must not be used to falsely suggest that the Company, a Service Performer, a regulator, payment network, certification body, professional organisation or other third party has approved, certified, endorsed or guaranteed the Customer, the Deliverable, the advertised product or the relevant business activity where no such approval exists.
Independent Service Performers may use the Platform to offer eligible Marketing Services, assess Project Requests, communicate with Customers and perform accepted Orders. They must provide accurate information about their identity, experience and services and may offer only work they are lawfully and professionally capable of performing.
All communications through the Platform must be accurate, relevant and professional. Users must cooperate reasonably in relation to Project Requests, Orders, delivery, revisions, payments, support, complaints, verification and fraud or security reviews.
4. Prohibited Technical and Behavioural Use
Users must not use the Platform in a manner that disrupts, damages, overloads, interferes with or compromises its operation, security, integrity or availability.
Automated access, including bots, scripts, crawlers, scrapers, artificial traffic tools or similar technologies, is prohibited unless expressly authorised by the Company in writing. Users must not systematically extract Platform data, Service Listings, User information, communications or other content without permission.
Users must not bypass, disable or circumvent authentication measures, access controls, rate limits, payment processes, security controls or other technical safeguards. Attempting to access another Account, private project information, User Materials, Deliverables, internal systems or supporting infrastructure without authorisation is prohibited.
The Platform must not be used to upload, transmit or distribute malware, viruses, corrupted files, malicious scripts or other code intended to damage, manipulate, monitor, disrupt or gain unauthorised access to the Platform, third-party services or another person's device or information.
Users must not manipulate or abuse Project Requests, Orders, communications, payments, payouts, refunds, complaints, reviews or support functionality. This includes submitting artificial or non-genuine Project Requests or Orders, creating false complaints, using fabricated evidence, initiating knowingly false or abusive chargebacks, manipulating Platform workflows or creating an unreasonable technical or operational burden.
Users must not use the Platform for phishing, spam, credential collection, impersonation, unauthorised data extraction, unlawful surveillance or the collection, disclosure or misuse of personal data without an appropriate lawful basis.
Account credentials must not be shared, sold or transferred. Users must not create Accounts using false identities, another person's information without authority or methods intended to evade a previous restriction, suspension or termination.
5. Responsible Content Use
Users are responsible for the User Materials, instructions and intended use submitted in connection with a Project Request or Order. All information supplied must be accurate, lawful and not materially misleading. Users must have the rights, licences, permissions and authority necessary to submit and use their materials for the relevant project.
Factual statements, product descriptions, comparative claims, testimonials, endorsements, performance claims, professional qualifications, regulatory status and licensing statements must be accurate and capable of substantiation.
Marketing Services and Deliverables must not be used to misrepresent a product, service, person or organisation, conceal material commercial information or falsely imply an affiliation, certification, approval, endorsement, licence or official status.
Users are responsible for ensuring that their Project Requests, User Materials and intended use of Deliverables comply with applicable advertising, consumer-protection, intellectual property, privacy, confidentiality and other legal requirements in the jurisdictions where the Deliverables will be published or used.
The Company may conduct administrative, security, fraud-prevention, compliance or Acceptable Use Policy reviews. Such review does not mean that the Company independently verifies every factual claim, licence, regulatory status, commercial representation or intended use.
Independent Service Performers must not knowingly create or deliver materially false, unlawful, infringing or deceptive content. They may request clarification or supporting information and may refuse a Project Request that they reasonably believe cannot be performed lawfully or consistently with this Policy.
6. Prohibited Content and Activities
The Platform, Marketing Services and Deliverables must not be used to create, promote, facilitate or support unlawful, fraudulent, deceptive, exploitative or materially harmful content or activity.
Prohibited content and activities include:
- fraud, phishing, scams, identity theft, impersonation, fabricated credentials, deceptive payment requests or other attempts to obtain money, information or access through misrepresentation;
- materially false or misleading advertising, fabricated reviews or testimonials, false endorsements, unsubstantiated performance claims, fake certifications or deceptive commercial communications;
- unlawful or unauthorised financial promotions, investment schemes, pyramid schemes, deceptive fundraising, credit fraud or other misleading financial activity;
- controlled substances, unlawful pharmaceuticals, weapons, explosives or other regulated goods or services where their promotion, sale or distribution is unlawful or requires an authorisation that has not been obtained;
- counterfeit goods, pirated or unauthorised software, content that infringes intellectual property, privacy, confidentiality, publicity or other third-party rights;
- malware, credential theft, unlawful surveillance, hacking, unauthorised access, data theft or other cyber abuse;
- human trafficking, forced or coercive labour, sexual exploitation or other forms of human exploitation;
- sexual content involving minors, non-consensual explicit material, sexual abuse material or content that facilitates sexual exploitation;
- content that incites or materially promotes violence, terrorism, violent extremism or participation in unlawful violent activity;
- hateful, discriminatory, threatening, harassing or abusive content directed at a person or group on the basis of protected or personal characteristics;
- defamatory content, unlawful threats, blackmail, extortion or deliberate harassment;
- academic cheating, fabricated academic credentials, plagiarism or false claims of authorship;
- activity intended to evade sanctions, export controls, legal restrictions, binding regulatory obligations or payment-provider requirements applicable to the relevant transaction; and
- any other content or activity that is unlawful or expressly prohibited by the Terms & Conditions.
The Platform must not be used by or for the benefit of a person or entity subject to applicable sanctions where providing Platform Services or Marketing Services would be prohibited or restricted.
7. Assessment of Eligibility and Intended Use
The Company may apply proportionate, risk-based measures to assess whether a Project Request, Order, User, Service Performer or intended use of Deliverables is eligible under this Policy.
Where reasonably necessary, the Company may request information about the relevant business activity, project purpose, campaign objective, intended audience, source of User Materials or proposed use of the Deliverables.
Any such assessment is limited to determining eligibility, administering the Platform, preventing fraud, protecting Platform participants and complying with contractual or legal obligations. It does not constitute an audit, regulatory review, professional verification, certification or endorsement of the User, Service Performer, business activity, User Materials or intended use.
The Company does not undertake to monitor every User, communication, Project Request, Order or Deliverable. A Project Request or Order is not approved, certified or guaranteed to be lawful merely because it was accepted, processed or delivered through the Platform.
Users and Service Performers must provide accurate and sufficiently complete information when reasonably requested for an eligibility, fraud, security or compliance review. They must not conceal material circumstances, submit fabricated evidence or provide information that is knowingly false or misleading.
Where reasonably requested information is not provided, or the available information does not allow the Company to determine that the activity is eligible, the relevant Project Request or Order may remain unconfirmed or paused pending clarification.
8. Enforcement and Account Measures
Where the Company reasonably believes that a User, Service Performer, Project Request, Order, User Material, Deliverable or other Platform activity breaches this Policy, the Terms & Conditions or applicable law, it may take proportionate action appropriate to the nature and seriousness of the issue.
Such action may include:
- requesting clarification, verification or supporting information;
- requiring the removal or amendment of User Materials, instructions or a Service Listing;
- rejecting a Project Request or refusing to confirm an Order;
- pausing an affected Order, transaction, payout, delivery or access to Deliverables while the matter is reviewed;
- cancelling unperformed or prohibited work;
- restricting particular Account, communication, upload or payment functionality;
- suspending or terminating an Account;
- refusing future Platform use; or
- cooperating with payment providers, financial institutions, regulators, courts or law enforcement authorities where permitted or required by law.
Measures may be applied where prohibited use is suspected or established, material information is false or misleading, an Account appears compromised, a User fails to cooperate with a reasonable review, or continued activity would create a material legal, security, payment, compliance or operational risk.
Where reasonably practicable, the Company will notify the affected User and provide an opportunity to clarify or remedy an issue that is capable of remedy. Immediate action may be taken without prior notice where reasonably necessary to prevent fraud, unlawful activity, unauthorised payments, security compromise, destruction of evidence or material harm.
Enforcement under this Policy does not automatically determine refund, payout, intellectual property or liability issues. Those matters will be handled under the Terms & Conditions, the applicable Order Confirmation and mandatory law.
9. Recordkeeping and Policy Review
The Company may maintain records reasonably necessary to assess eligibility, investigate suspected Prohibited Activities, administer enforcement measures, resolve disputes and demonstrate compliance with its contractual and legal obligations.
Such records are processed, protected, disclosed and retained in accordance with the Privacy Policy and applicable law. Internal assessments under this Policy do not constitute a regulatory audit, certification, legal opinion or endorsement of a User, Service Performer, business activity or Deliverable.
The Company may update this Policy to reflect changes in applicable law, Platform functionality, available Marketing Services, security or fraud risks and operational requirements.
The current version and revision date will be published on both Websites. Where a change is material, reasonable additional notice may be provided through the Website, Account, email or another appropriate communication method.
